I humbly submit for your Lordship's consideration that Rule 108 does not apply to the circumstances of the present case. It only deals with two contingencies: one, where an officer is appointed to act in a higher grade than his own, continuing entirely to perform the duties of his own office; the other, where an officer on appointment assumes also the duties of another officer in that capacity. The Rule does not provide for such an arrangement as the present one, and does not contemplate it as any possible.
